Please read these Terms carefully. By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms.
By using this website or entering into a service agreement with Now Say That, you acknowledge that you are at least 18 years of age, have the legal capacity to enter into contracts, and agree to these Terms in full. If you are accessing the site on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate proposal or agreement provided to the client prior to commencement of work.
All client projects begin only upon receipt of a signed proposal or written confirmation of engagement and the agreed advance payment. By confirming an engagement, both parties agree to:
Our work: All creative work, concepts, designs, copy, strategies, and deliverables produced by Now Say That remain our intellectual property until full payment has been received. Upon receipt of full payment, ownership of the final agreed deliverables transfers to the client.
Our process materials: Preliminary concepts, drafts, mood boards, research, and internal process documents remain the property of Now Say That and are not included in the deliverable handover.
Portfolio rights: We reserve the right to display completed work in our portfolio, website, social media, and marketing materials unless the client has expressly requested confidentiality in writing.
Client-provided materials: You represent that any content, images, logos, or other materials you provide to us are owned by you or that you have the rights to use them. You indemnify Now Say That against any claims arising from client-provided materials.
Both parties agree to keep confidential any proprietary information, business strategies, client data, pricing, or trade secrets shared during the course of the engagement. This obligation continues for a period of two (2) years after the termination of the engagement.
This clause does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
Now Say That's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.
We do not guarantee specific results from marketing, advertising, or social media campaigns, as outcomes depend on many factors outside our control (market conditions, platform algorithms, audience behaviour, etc.).
By the client: A client may terminate an engagement by providing written notice. Any work completed up to the point of termination will be invoiced and must be paid. Advance payments already made are non-refundable.
By Now Say That: We reserve the right to terminate an engagement if the client engages in conduct that is abusive, unethical, or in violation of these Terms, or if payment obligations are not met. In such cases, payment for all work completed to date remains due.
